Attacker spared jail after victim's plea

A father-of-two who glassed a man in a pub was spared jail after the victim wrote to the judge asking for leniency.

Lee Sheehan lost his temper when the man insulted him and smashed a glass on his head, causing two cuts and grazing.

It happened in the Horse and Trumpet, in Bull Head Street, Wigston, on the evening of January 9.

Sheehan (35), of Heards Close, Wigston, admitted causing actual bodily harm.

Barbara Graham, prosecuting, said the defendant had objected to banter between the complainant and a female bar worker.

The two men, who did not know each other, then exchanged words.

The victim carried drinks away from the bar but then insulted Sheehan.

The defendant went over to him and smashed the glass on his head, striking him two or three times.

Ms Graham said the victim went to hospital, where the cuts were surgically glued.

Philip Gibbs, in mitigation, said the incident was out of character and had put Sheehan's future in jeopardy – including plans to emigrate with his family to Australia.

Sheehan now realised he had been drinking to excess and has since sought advice from his GP.

Mr Gibbs said that, in a letter to the court, the victim had urged a non-custodial sentence be passed, especially considering the defendant was a family man with children.

The victim, who has made a good recovery, also accepted he had made an inflammatory comment.

Sheehan, in a letter to the judge, said he was "sorry, upset, ashamed and disgusted with himself".

Judge Hammond said he had intended jailing Sheehan but had changed his mind due to "exceptional circumstances" of the case.

He said: "The complainant has taken a particularly decent attitude and it's clear he shouldn't have behaved in the way he did either."

Sheehan was sentenced to a one-year community order with supervision and an alcohol treatment requirement, and to do 150 hours of unpaid work.
